D'Loop is an app for finding events, communities, and people nearby. By using D'Loop you are agreeing to be bound by the following terms and conditions ("Terms of Service").
Please read these carefully. Violation of any of the Terms of Service may result in the suspension or termination of your account.
1. The Service & Definitions
- When we say "our", "we", or "us", we mean KumaPixel Inc. ("Company").
- When we say "D'Loop" or "Service", we mean the D'Loop mobile app and the website dloopconnect.com.
- When we say "you", we mean the person using the Service.
- When we say "content", we mean anything you post, upload, or send on the Service, such as posts, photos, messages, and events.
2. Account Terms
- You must be at least 18 years old to use the Service. D'Loop is built for meeting people in person, so we don't make exceptions.
- You must provide accurate information when you sign up, and you may not impersonate anyone else.
- You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to do so. If you think someone else has access to your account, let us know right away at support@dloopconnect.com.
- Accounts registered by "bots" or other automated methods are not permitted.
- You are responsible for your content and all activity that occurs under your account.
- You may not use the Service for any illegal purpose or to violate the rights of others.
- The Service is free to use.
3. Account Deletion
You can ask us to delete your account at any time by emailing support@dloopconnect.com from the email address on your account. Your personal information will be removed from our active systems within 30 days and from our backups within 60 days. Messages you sent to others may remain visible to them. See our Privacy Policy for details.
4. Account Suspension & Termination
The Company, in its sole discretion, has the right to suspend or terminate your account and remove your content for any reason at any time, including for violating these Terms of Service.
Think we got it wrong? Email support@dloopconnect.com from the email address on your account and tell us why. A real person will review your appeal.
5. Modifications to the Service
The Company reserves the right at any time to modify or discontinue, temporarily or permanently, any part of the Service with or without notice. The Company shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
6. Your Content
- You retain all ownership rights in your content. Your content must not violate any law or anyone else's rights.
- By posting content, you grant us the right to store, display, and process it to provide the Service. Without these rights, we couldn't offer the Service.
- We may remove, restrict, review, or retain any content as necessary to enforce these Terms, comply with the law, or keep the Service safe. Uploaded photos are automatically screened, and members can report content to us.
- If you send us feedback or ideas, we may use them to improve the Service.
- We retain all rights in the Service itself. Using the Service does not give you ownership of it or of other members' content.
7. Copyright Infringement Notices
If you believe content on the Service infringes your copyright, email legal@dloopconnect.com with a description of the work, where the content is located on the Service, and your contact information, and we will review it.
8. Your Use of the Service & Restrictions
- Be respectful. You must not harass, threaten, or harm other members, or post content that is hateful, sexually explicit, or illegal.
- You must not modify, hack, or disrupt the Service.
- You must not use data mining, scraping, robots, or similar tools to access the Service.
- You must not spam other members or use the Service for unsolicited advertising.
- Abuse of any Company employee or agent will result in immediate account termination.
9. Hosts & Communities
- When you host an event or run a community, you decide who can join, approve or decline requests, and remove people who don't fit. You can also set your own house rules, as long as they don't conflict with these Terms.
- Hosts and community admins may remove you from their event or community at their discretion. That's their call, not ours.
- If you host, you're responsible for your event: describe it honestly, keep the details up to date, and cancel in the app if plans change.
- Treat attendees' and members' information with care. Use it only to run your event or community, and never share it, sell it, or use it for anything else.
10. Events & Meeting People
- D'Loop helps you find events and meet people in real life, but we're not a party to any event or plan made through the Service. Events are organized by members, not by us.
- We don't run background checks on members, and we don't verify that members or events are who or what they say they are.
- Some activities carry real risks, like injury or illness. When you attend an event, you choose to take on those risks.
- To the maximum extent permitted by law, you release the Company and its team from any claims arising from your interactions with other members, or from any event you host or attend.
- Use good judgment: meet in public places, tell a friend where you're going, and report anyone who makes you feel unsafe.
11. Service Disclaimers
Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. We use third-party providers to run the Service and make no promises about their technology. We don't promise that the Service will be uninterrupted, secure, or error-free. To the extent permitted by law, we exclude all warranties.
12. Liability for our Service
To the maximum extent permitted by law, the Company and its agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Service, your inability to use it, the conduct of other members, or any event you host or attend, including lost data or unauthorized access to your account.
In any case, our total liability to you is limited to $100 CAD. This doesn't limit liability for our gross negligence, fraud, or intentional misconduct, or any rights you have under consumer protection laws that can't be waived.
13. Indemnification
To the maximum extent permitted by law, you agree to cover the Company's costs, including reasonable legal fees, if someone makes a claim against us because of your content, your use of the Service, your conduct at an event, or your violation of these Terms or anyone's rights.
14. General
- These Terms of Service are the entire agreement between you and the Company and replace any prior versions.
- We may contact you by email or through the Service, and those notices satisfy any requirement that communications be in writing.
- We may modify these Terms of Service at any time. By continuing to use the Service after changes, you agree to the revised Terms.
- The Service may link to third-party websites. That doesn't mean we control or endorse them.
- These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If any provision is unenforceable, the rest remain in effect.
- Questions may be sent to support@dloopconnect.com.
